Such modifications will not apply to reservations made prior to the changes.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 2<\/u>\u00a0: Reservation<\/strong><\/h2><p>2.1 The customer may make a reservation by calling the Establishment and providing the information necessary for the reservation. The reservation is deemed to have been made on the date the deposit, equal to 30% of the price of the reserved services, is paid. If the deposit is not paid, the Establishment does not guarantee the availability of the services.<br \/>2.2 A reservation confirmation is sent to the customer in writing via any means to the address provided by the customer. This confirmation summarizes the contract offer, the services reserved, the prices, and the address of the Establishment to which the customer may submit complaints.<br \/>2.3 In the event of any conflict between the provisions set forth in the reservation confirmation sent to the customer and those set forth in these General Terms and Conditions of Sale, the provisions of the reservation confirmation shall prevail.<br \/>2.4 For half-board, the meal must be taken during the evening service.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 3<\/u>\u00a0: Price<\/strong><\/h2><p>3.1 The prices for the services included in the reservation are listed in the brochure in effect at the time of the reservation and on the reservation form.<br \/>3.2 Prices are displayed in euros, inclusive of tax. They reflect the VAT rate in effect on the date of booking, and any change in the applicable VAT rate will be automatically reflected in the prices shown.<br \/>3.3 Unless otherwise stated in the offer description, prices do not include:<br \/>\u2013 the tourist tax;<br \/>\u2013 insurance;<br \/>\u2013 medical fees; ;<br \/>\u2013 meals not included in the selected package;<br \/>\u2013 beverages;<br \/>\u2013 and, in general, all personal expenses.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 4:<\/u>\u00a0Regulations<\/strong><\/h2><p>4.1 The deposit amount is deducted from the initial invoice; the balance for the services must be paid on site before the customer\u2019s departure.<br \/>4.2 For reservations that include a stay with lodging, a spa treatment, full board, or half board, meals and treatments not used will not be deducted from the final bill.<br \/>4.3 The Company will not grant any discount for payment made earlier than the date specified in these General Terms and Conditions of Sale or on the customer\u2019s invoice.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 5<\/u>\u00a0: Late or Non-Payment<\/strong><\/h2><p>With respect to business customers, any amount not paid by the due date indicated on the invoice automatically results, as of the following day, late payment penalties equal to three times the statutory interest rate, as well as a flat-rate indemnity for collection costs in the amount of \u20ac40. If the collection costs exceed this compensation, the Institution may request additional compensation from the customer, upon providing justification.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 6<\/u>\u00a0: Customer Cancellation<\/strong><\/h2><p>6.1 Any cancellation, whether total or partial, must be notified to the Institution in writing and, unless otherwise specified, will result in the following charges:<br \/>\u2013 For any cancellation made more than 10 days before the arrival date, the property will refund the deposit paid by the guest, minus an administrative fee of 50 euros per person whose reservation is canceled,<br \/>\u2013 For any cancellation made 10 days or fewer than 10 days before the arrival date, the property will retain the full amount of the deposit paid.<br \/>6.2 The corresponding amounts will be refunded to the customer within a maximum of 30 days from the date of notification of the cancellation, via a credit to the customer\u2019s bank account.<br \/>6.3 If the guest interrupts the treatment or stay at the Facility, or does not use certain services for any reason whatsoever\u2014including, but not limited to, failure to show up or arriving late at the appointment location\u2014the guest remains liable for all amounts due under the initial reservation. The customer must therefore pay the balance before leaving the Facility.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 7<\/u>\u00a0: Changes Requested by the Client<\/strong><\/h2><p>7.1 Any changes to the reservation made by the guest may be accommodated by the Establishment only to the extent possible and provided that they are notified in writing (by mail, fax, or email) to the Establishment at least 15 days prior to the scheduled arrival date. The Establishment will endeavor, to the extent possible, to accommodate these requests.<br \/>7.2 If these requests for changes involve an extension, an increase in the number of people, or the purchase of an additional service, only the cost of these changes will be billed as an additional charge.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 8<\/u>\u00a0: Eviction \/ Termination by the Institution<\/strong><\/h2><p>8.1 If, prior to departure, compliance with one of the essential terms of the contract is rendered impossible as a result of a force majeure event beyond the Establishment\u2019s control, the Establishment must notify the customer and inform them of their option to either terminate the contract or propose a modification.<br \/>8.2 This notice must be confirmed by email or by certified mail with return receipt requested to the customer, who must indicate their decision as soon as possible. Upon terminating the contract, the customer is entitled to a refund of all amounts paid.<br \/>8.3 If the reserved service is unavailable, the customer will be notified by the Establishment, which agrees to refund the corresponding amount within 30 days of the Establishment becoming aware of the force majeure event.<br \/>8.4 Management reserves the right to cancel or modify booked services without prior notice if the conditions for providing such services prove to be incompatible with the training of our hydrotherapists and estheticians (health status, level of independence, etc.). .<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 9<\/u>\u00a0: Room Check-in<\/strong><\/h2><p>Rooms are available to guests starting at 4:00 p.m. and must be vacated by 12:00 p.m. on the day of departure. However, depending on the hotel\u2019s availability, upon request the day before your departure and for an additional fee (please check with the hotel front desk), guests may keep their room until 5:00 p.m.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 10<\/u><\/strong><strong>\u00a0: Medical appointments<\/strong><\/h2><p>For packages of 4 days or more: Customers must present a medical certificate confirming their fitness to participate in thalassotherapy and stating that there are no contraindications, issued within the last 3 months. For stays of fewer than 4 days: a medical examination, while optional, is recommended. If the guest does not have a medical certificate of fitness, they will be asked to sign a medical waiver on site.<br \/>Thalassotherapy treatments are strongly discouraged for pregnant women.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 11<\/u>\u00a0: Hygiene Measures<\/strong><\/h2><p>For hygiene reasons, plastic sandals must be worn. Swim shorts and burkinis are not allowed in the pools. In addition, spa guests are advised to bring two swimsuits.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 12<\/u>\u00a0: Liability<\/strong><\/h2><p>12.1 The Establishment shall not be held liable for failure to fulfill the reservation in the event of force majeure, acts of third parties, or acts of the customer.<br \/>12.2 Children under the age of 16 are not permitted to use the sauna, steam room, or fitness center. The Facility shall not be held liable in any way in the event of a failure to comply with this requirement.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article<\/u><\/strong><strong><u>e 13<\/u> : Complaints<\/strong><\/h2><p>13.1 Any complaints regarding the condition of the premises must be brought to the attention of the Establishment within 24 hours of the guest\u2019s arrival.<br \/>13.2 Claims regarding non-performance or improper performance of the contract will be considered only if they are submitted in writing (by mail, fax, or email) and addressed to the Institution.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 14:<\/u> Privacy Policy<\/strong><\/h2><p>The data collected is processed by the Establishment and is necessary to manage the reservation, better understand the customer, and send information about the Establishment\u2019s products and services. In accordance with Law No. 78-17 on Information Technology, Data Files, and Civil Liberties, each customer has the right to access, inquire about, correct, and object to the use of their personal data by the Establishment.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><h2><strong><u>Article 15<\/u>\u00a0: Governing Law \/ Dispute<\/strong><\/h2><p>15.1 The applicable law is French law.<br \/>15.2 In the event of a dispute, and in the absence of an amicable settlement between the parties, the case shall be brought before the court with territorial jurisdiction.<br \/>15.3 The customer is informed by the Establishment of the possibility of resorting, in the event of a dispute regarding these general terms and conditions, to a contractual mediation procedure or any other alternative dispute resolution method, under the conditions set forth in Title I of Book VI of the Consumer Code.
